Terms and Conditions

1. Scope of Services
ENGINERIT CONSULTORIA TECNOLOGICA S.L. ("enginerIT") provides IT consulting, technical support, remote desktop solutions (RDP for desktop applications such as A3, Sage, etc.), VPN services, server administration, cloud hosting (via Hostbrid), and related technology infrastructure services. The specific services contracted are detailed in each client's service agreement.
2. Service Agreement
By contracting our services, you accept these general terms and conditions. Specific service terms, including scope, duration, and pricing, are detailed in individual service proposals or contracts which take precedence over these general terms where applicable.
3. Payment Terms
- Invoicing: Services are invoiced monthly or as agreed in the service contract. All prices include IVA (21%) unless stated otherwise.
- Payment methods: Bank transfer, direct debit, or online payment as agreed.
- Late payment: Invoices not paid within 30 days of issuance may incur late payment interest at the legal rate established by Spanish law (Ley 3/2004).
- Service suspension: We reserve the right to suspend services after 15 days of non-payment, with prior written notice.
4. Service Level Agreement (SLA)
- Response time: Critical incidents: 2 hours. Standard requests: 8 business hours. Consultations: 24 business hours.
- Support hours: Monday to Friday, 9:00 - 18:00 CET. Emergency support available 24/7 for contracted clients.
- Remote infrastructure uptime: 99.9% monthly uptime for managed servers and RDP services. Excludes scheduled maintenance (communicated 48h in advance).
- SLA credits: If monthly uptime falls below 99.9%, clients may request a credit proportional to the downtime duration, up to 30% of the monthly service fee.
5. Remote Desktop (RDP) Services
RDP services provided by enginerIT are designed exclusively for accessing professional desktop applications (e.g., A3, Sage, ERP/CRM systems) from any location. These services are:
- Application-specific: Intended for running contracted desktop applications, not for general web browsing or personal use.
- Shared or dedicated: Resources are allocated according to the contracted plan (shared or dedicated server).
- Licensed: Software licenses (Windows Server, applications) are the client's responsibility unless included in the contracted plan.
6. Client Obligations
- Provide accurate and complete information necessary for service delivery.
- Maintain the confidentiality of access credentials provided.
- Use services in compliance with applicable laws and these terms.
- Ensure valid software licenses for applications hosted on our infrastructure.
- Notify us promptly of any security incidents or unauthorized access.
7. Acceptable Use
You agree not to use our services for:
- Any illegal activity or activity that violates third-party rights.
- Distribution of malware, spam, or unauthorized access to systems.
- Activities that consume excessive resources or degrade service quality for other clients.
- Storing or processing data that violates data protection regulations.
8. Confidentiality
Both parties agree to maintain the confidentiality of all proprietary information exchanged during the service relationship. This obligation survives termination of the service agreement for a period of 2 years.
9. Limitation of Liability
ENGINERIT CONSULTORIA TECNOLOGICA S.L. shall not be liable for indirect, incidental, or consequential damages. Total liability is limited to the fees paid by the client for the affected service in the 12 months preceding the claim. Force majeure events are excluded from liability.
10. Termination
- By client: You may cancel services with 30 days written notice. Prepaid fees for unused periods are refundable on a pro-rata basis.
- By enginerIT: We may terminate services for breach of these terms, non-payment (after 30 days notice), or illegal use.
- Data return: Upon termination, we will provide your data in a standard format within 30 days. After 60 days, data may be permanently deleted.
11. Changes to These Terms
We may update these terms periodically. Significant changes will be communicated 30 days in advance via email. Continued use of services after changes take effect constitutes acceptance.
12. Applicable Law and Jurisdiction
These terms are governed by Spanish law. Any dispute shall be submitted to the courts and tribunals of Barcelona, Spain, unless otherwise required by applicable consumer protection legislation.
